Welcome to TourCraft! These Terms of Service ("Terms") govern your access to and use of TourCraft, a browser-based text golf RPG game. By accessing or using TourCraft, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using TourCraft ("the Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

2. Eligibility

You must be at least 13 years of age to use TourCraft. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you must have permission from a parent or legal guardian to use the Service.

3. Account Registration

3.1 Account Creation

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account

3.2 Account Security

  • Choose a strong password and keep it confidential
  • Do not share your account with others
  • We reserve the right to suspend or terminate accounts that violate these Terms

4. Game Play and Virtual Items

4.1 Game Progression

  • TourCraft is a skill-based progression game where you develop your golfer's attributes through gameplay
  • Experience points (XP), tournaments, and character statistics are virtual items with no real-world monetary value
  • Your progress is tied to your account and cannot be transferred or sold

4.2 Virtual Currency and Items

  • Any virtual currency, items, or achievements earned in TourCraft have no cash value
  • We reserve the right to modify, remove, or add virtual items at any time
  • Virtual items are licensed to you for personal, non-commercial use only

4.3 Fair Play

You agree not to:

  • Use cheats, exploits, automation software, bots, hacks, or any unauthorized third-party software
  • Engage in any form of cheating or abuse of game mechanics
  • Manipulate game data or interfere with the game experience of other players
  • Use bugs or glitches to gain an unfair advantage

5. User Conduct

You agree to use TourCraft in a respectful and lawful manner. You will not:

  • Harass, abuse, threaten, or intimidate other users
  • Use offensive, vulgar, or inappropriate language
  • Impersonate any person or entity
  • Upload or transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Engage in any activity that disrupts or interferes with the Service
  • Use the Service for any illegal purpose
  • Sell, trade, or attempt to profit from your account or any game content

6. Intellectual Property

6.1 Ownership

  • TourCraft, including all content, features, functionality, source code, and game mechanics, is owned by TourCraft and is protected by copyright, trademark, and other intellectual property laws
  • The TourCraft name, logo, and all related graphics are trademarks of TourCraft

6.2 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use TourCraft for personal, non-commercial purposes, subject to these Terms.

6.3 Restrictions

You may not:

  • Copy, modify, distribute, sell, or lease any part of the Service
  • Reverse engineer or attempt to extract the source code
  • Create derivative works based on the Service
  • Remove or modify any copyright or proprietary notices

7. User-Generated Content

7.1 Your Content

If TourCraft allows you to submit content (such as golfer names, profile information, etc.), you retain ownership of that content but grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it as part of the Service.

7.2 Content Standards

Any content you submit must:

  • Be accurate and not misleading
  • Comply with applicable laws
  • Not infringe on others' intellectual property rights
  • Not contain offensive, harmful, or inappropriate material

8. Termination

8.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

8.2 Termination by Us

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Any other reason at our sole discretion

8.3 Effect of Termination

Upon termination:

  • Your right to access and use the Service will immediately cease
  • All licenses granted to you will terminate
  • We may delete your account data, including game progress and virtual items
  • Sections of these Terms that should reasonably survive termination will continue to apply

9. Disclaimers and Limitation of Liability

9.1 "As Is" Service

TourCraft is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.2 Service Availability

  • We do not guarantee that the Service will be uninterrupted, secure, or error-free
  • We may modify, suspend, or discontinue any part of the Service at any time
  • We are not responsible for any loss of data, game progress, or virtual items

9.3 Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability to you for all claims related to the Service shall not exceed $100 USD or the amount you paid to us in the past 12 months, whichever is greater
  • Some jurisdictions do not allow limitations on certain warranties or damages, so some of these limitations may not apply to you

10. Indemnification

You agree to indemnify, defend, and hold harmless TourCraft and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Any content you submit to the Service

11. Changes to the Service and Terms

11.1 Service Changes

We reserve the right to:

  • Modify or discontinue any feature of the Service
  • Change game mechanics, algorithms, or balance
  • Add or remove content at any time

We may update these Terms from time to time. When we do:

  • Significant changes will be communicated through the Service or via email
  • Your continued use of the Service after changes constitutes acceptance of the revised Terms

If you have a dispute with TourCraft, please contact us first to attempt informal resolution.

12.2 Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which TourCraft operates, without regard to conflict of law principles.

12.3 Arbitration

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law. You waive your right to participate in class action lawsuits or class-wide arbitration.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TourCraft regarding the Service.

13.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations without restriction.

14. Special Provisions for Minors

If you are under 18 years of age:

  • You must have parental or guardian consent to use TourCraft
  • Your parent or guardian is responsible for your use of the Service

15. Beta Testing and Early Access

If you are participating in any beta, early access, or testing phase of TourCraft:

  • The Service may contain bugs, errors, or incomplete features
  • Features may be added, changed, or removed without notice
  • Game progress may be reset
  • Additional testing terms may apply
